Realtors have to take a Law and Ethics class when they get the Realtor designation. They are taught that it is unethical for them to lie to the client and say that there is another offer. They can say that there has been some interest or they EXPECT an offer, however, they can not tell you there is another offer if there isn’t one.

I have never had that problem. I would think that the realtor is far more interested in making a sale than trying to make a few extra bucks by playing games and risk losing the sale altogether.
If you are uncomfortable with your offer supposedly being topped by someone else just walk away and say ‘I am not going to participate in a bidding war’. Realtors love the idea of a bidding war. Don’t rush into anything. Who knows? Your realtor may come back to you in a few weeks and say ‘the other buyer’s offer fell through–are you still interested in putting in an offer?"

I am a Realtor. I have never had any landlord accept less than list for a rental or lease. On a sale we negotiate all the time. In your area it must be very different.

On sales, every single time I write an offer on a bank owned property the Realtor has my buyer sign a note acknowledging that they have been told they are competing against other buyers. I find it hard to believe that is always true- so- yes I think I have been lied to at least some of the time.

In my area, it has become standard practice for a realtor to tell a prospective buyer that another offer has been made in an attempt to get the buyer to up his offer, thereby squeezing that extra dollar of commission out of the deal.

It is done so much that you don’t know if it is a real offer or not. If you refuse to up your offer, you risk losing the property. Look for several pieces of property and make offers on the one that appeals to you the most.

If the realtor says another offer is in the works, tell the realtor you won’t enter into a bidding war. Withdraw your offer and move on to the next piece of property. After they loose a few commissions for being sleezy, they may clean up their act.

The agent should have never answered those questions and recommended that you see a tax attorney. Unfortunately she answered and now you are stuck with the problem. Is she with a real estate group (Century21, etc?). I would write them a letter or call them.

If PMI has to pay off, you will get a 1099-C for the cancelled debt (if they don’t try to make you pay it).

If the loan was on your HOME and you never refinanced to pay off credit cards, you are eligible at the federal level for the debt forgiveness act. Instead of putting this down as income, you use form 982. If your CPA didn’t know about this form, I’ve got a problem with the CPA. If he told you that you weren’t elgibile, that’s different.

I am sorry, but that is YOUR fault for listening to tax advice from a real estate agent and NOT a tax professional. Do you think you can sue your CPA for telling you that you don’t have cancer when in fact you do?? Same exact concept. Also, it sounds like YOU did not do YOUR due diligence about this agent. You should have NEVER believed her when she said she was the "only" agent who specialized in short sales. Common sense alone tells me that is not true….especially in the current market. At least 80% of the blame for this is squarely on YOUR shoulders.

Why were you asking a realtor for tax advice? Realtors are not tax experts. You can’t pin the blame for taxes you incurred on a realtor.
